But the authorities quickly decided to crack down. The reason? The European Union authorized the sale of CBD products containing up to 0.2% THC. France, on the other hand, was more restrictive, with CBD products authorized for sale on the sole condition that THC levels were... zero. This led to a number of seizures and court cases, including the Kanavape case, which had a major impact on the cannabidiol market in France.
The Kanavape case in brief
The Kanavape case is a trial that took place in France concerning the legality of selling e-cigarettes containing CBD, a cannabinoid found in cannabis that is said to have therapeutic properties without the psychoactive effects of THC.
The Kanavape company was one of the leading sellers of CBD-containing e-cigarettes in France, but has been prosecuted for the illegal sale of cannabis products. The trial sparked much discussion about the legalization of CBD and its therapeutic use in France.
A trial in which the company was finally found guilty. But no matter. Group founder Sébastien Bergueri decided to appeal. The Aix-en-Provence Court of Appeal took up the case. However, the Court declared itself incompetent and turned to the Court of Justice of the European Union (CJEU). After several years of waiting, the CJEU finally ruled in favor of the company.
This decision marks a major turning point in the world of French CBD:
- France has been found guilty of hindering the free movement of goods within Europe, by preventing CBD products containing trace amounts of THC from circulating;
- CBD products of all kinds are authorized for sale, provided they comply with the 0.2% THC limit.
The government decides otherwise
However, the government decided to counter-attack. A decree was quickly issued. This order prevents the production and sale of CBD flowers, regardless of their THC concentration. In addition, the executive stipulated that only professional farmers were now allowed to produce hemp.
This decision has not gone down well with many people. On the one hand, producers and retailers of CBD products. For them, it's a real setback. At a time when the market is booming, and the CJEU ruling has reinforced their decision to work in this field, the government is imposing new restrictions.
Secondly, for consumers. Although Flowers CBD cannot be smoked, it remains particularly effective, whether in herbal tea or vaporized form. This second method of consumption is considered to be one of the safest and quickest.
As a result, petitions were created and signed. The decree, on the other hand, was blocked in court by Aurélien Delecroix, president of the Syndicat Professionnel du Chanvre (Professional Hemp Syndicate), who, along with other players, attacked the decree. After several months of waiting and misunderstanding, the Conseil d'Etat (the French Council of State) ruled on the matter.
The Conseil d'Etat's response
On December 20 last year, the Conseil d'Etat took up the matter and set about providing a clear and definitive answer to a problem that really shouldn't be one. Almost a year to the day after the governmental decree was issued, it was... retracted. In fact, the applicants have won their case.
The Conseil d'Etat considered that this ban on the marketing of Flowers CBD in its raw state was "disproportionate". The minutes also state that the Conseil d'Etat underlined the fact that, to date, there are absolutely no scientific studies proving that the consumption of Flowers CBD poses a risk to public health.
"Based on current scientific data, the harmfulness of the other molecules present in Flowers and cannabis leaves, in particular CBD, has not been established". A decision welcomed by many, including Aurélien Delecroix. Speaking to Libération, he says: "From a legal point of view, we had reasonable confidence in the decision, but it's still a relief for the industry. At first, the government even wanted to ban the CBD molecule. We haven't lost a single battle, and the law is on our side.
But that's not all. The Conseil d'Etat went a step further than expected. It pointed out that cannabidiol is a cannabinoid known and recognized for its action on stress and anxiety. This action is not accompanied by any psychoactive effects, or even dependence. Before concluding, the Conseil d'Etat points out that, to date, law enforcement agencies also have all the tools they need to differentiate between CBD and THC. In short, this decision endorses a subject that began... with the Kanavape affair.
