Recall of CBD - THC candies throughout France

CBD candies, too high in THC, recalled

In France, as in the rest of the European Union, CBD is authorized for sale and consumption, provided that THC (tetrahydrocannabinol) concentrations are strictly below 0.3%. However, as with other mass-market products, certain problems can arise. This is notably the case with CBD candies from the CBD SOL and Mama Kana brands which, after analysis, ended up containing more THC than the authorized dose.

French legislation on CBD

In France, CBD legislation has long been difficult to understand. It wasn't until the famous Kanavape case and the ruling of the CJEU (Court of Justice of the European Union) that the executive took a definitive position.

Today, CBD-based products are perfectly legal for sale and consumption in France, as long as they contain less than 0.3% THC. THC (tetrahydrocannabinol) is the psychotropic molecule in the cannabis plant. When consumed, it produces the "high" effects.

As a result, many brands are launching and announcing the arrival on the market of products rich in CBD, but low in THC (in some cases, these products don't even contain any). But recently, the CBD SOL and Mama Kana brands have run into a bit of a problem.

What the French Health Insurance says about CBD

Rest assured, and reassure your customers, CBD is not being singled out - far from it! In addition to legislation, the Assurance Maladie itself points out that cannabidiol is an authorized molecule. " As CBD and THC are 2 active compounds found in cannabis leaves, CBD-based products may contain traces of THC. Only the quality of CBD purchased can guarantee that it is sufficiently purified and no longer contains significant quantities of THC".

CBD SOL candies recalled

Government information website RappelConso has confirmed on its platform and social networks the recall of CBD SOL brand candy. According to initial information, THC levels exceed "the acceptable daily exposure dose for public health".

However, this recall does not concern all the brand's products or candies! In fact, only raspberry gummies, watermelon gummies and mint gummies. These CBD candies were sold in "5-unit packs" between March 23 and August 1.

Lots 01020, 01019 and 01021 are affected by this recall. The best-before dates are March 19, 2024 and March 19, 2025. They are easy to recognize, since, as the name suggests, raspberry candies are red, watermelon candies are green and mint candies are dark green.

Are other brands concerned?

Yes, other brands are involved in the recall of similar products, including Mama Kana brand candies. These were sold (on B2B platforms and elsewhere, in CBD Shops) over the period 09/01/2023 to 27/07/2023. Lot 01020 is concerned (use-by date 19/03/2024).

These are raspberry-flavored candies. The Mama Kana brand also offered watermelon and mint candies on its platform (as well as on B2B wholesale platforms). These were sold nationwide between 22/12/2022 and 01/08/2023. Lots 01021, 01019 and 01020 are also concerned.

What to do if you've bought some?

Are you directly affected by the purchase of a bag of CBD gummies - THC CBD SOL, Mama Kana or Le Grossiste CBD? You have until October 31 (2023) to return your pack of gummies. You can then get your money back. Otherwise, if you decide to keep them, you could be prosecuted, notably for drug use.

A toll-free number has also been set up by the government agency RappelConso. If you have the slightest question or doubt, don't hesitate to call 09 74 97 01 27. A dedicated expert will be there to advise, guide and help you.

The importance of verifying origins

This episode clearly shows that it is absolutely essential for CBD product producers, retailers and consumers to always pay attention to the provenance of products. Indeed, some professionals are much less careful about product quality, which in the end can have an impact on the end consumer as well as on the CBD industry as a whole, which can be singled out for criticism.

Whether you're a retailer (CBD Shop or online) or a consumer, never hesitate to ask for product analysis and production certificates. This is the best way to prove the quality and legality of your products, and avoid any problems. For further information, please do not hesitate to contact us.
